ZapView — Acceptable Use & Community Safety Policy
Version: 0.1 (DRAFT) Effective date: 2026-06-05 Applies to: All ZapView users (Requesters and Providers) Owner: ZapView, Inc.
⚠️ Draft — not legal advice. This document is engineering/product boilerplate intended to be reviewed and finalized by qualified legal counsel before publication. It must be hosted at a public URL (e.g., zapview.app/acceptable-use) and linked from the in-app consent screen before launch. It supplements — and does not replace — the ZapView Terms of Service and Privacy Policy.
1. Eligibility
You must be at least 18 years old to use ZapView. Accounts found to belong to anyone under 18 will be removed.
By using ZapView you confirm you have the legal capacity to enter into these terms in your jurisdiction.
2. How ZapView works (summary)
A Requester asks for a short, live view of a real-world location. A nearby Provider streams live video from that location for a fixed duration. ZapView facilitates the match, the live session, and payment. ZapView is a neutral platform and is not the author of user content.
3. Prohibited conduct
You may not use ZapView to, and you may not stream, request, or transmit content that:
Depicts, sexualizes, or endangers minors in any way. This includes any child sexual abuse material (CSAM). Zero tolerance.
Constitutes non-consensual intimate imagery (NCII), voyeurism, "upskirting," or filming people in places with a reasonable expectation of privacy (restrooms, changing rooms, inside private homes).
Harasses, stalks, threatens, or surveils any person, including repeated targeted requests at a specific individual, residence, or workplace.
Films in prohibited or geofenced zones (e.g., schools, hospitals, secure facilities) where ZapView has disabled service.
Is illegal, promotes violence or terrorism, infringes intellectual property, or violates the privacy or other rights of any person.
Is intended to identify, track, or profile private individuals without consent.
Providers must use the in-app privacy tools (including face-obscuring features where available) and must not deliberately defeat them.
4. Privacy and filming standards
ZapView applies privacy protections (including bystander face-obscuring and geofenced no-service zones) on a best-effort basis. These protections assist compliance; they do not relieve you of your own legal obligations when filming.
ZapView operates anti-surveillance limits (e.g., caps on repeated requests to the same location) to deter stalking and monitoring.
Live sessions are not routinely recorded. See Section 8 for the limited, report-triggered evidence capture.
5. Reporting violations
Any user may report a session they believe violates this Policy using the in-app Report control.
Reporting is one tap plus a reason — you are not required to provide your own screenshots or recordings.
When you submit a report, ZapView may automatically capture a short segment or still frames of the reported session to enable fair review (see Section 8). This captured evidence is created by the platform, not by you.
For emergencies or imminent danger to a person, contact local emergency services first.
6. Good-faith reporting and reporter accountability
ZapView relies on honest reports to keep the community safe. This Section is designed to protect users who act in good faith — both honest reporters and users who are wrongly accused — while deterring abuse of the reporting system.
6.1 Protection for good-faith reporters
If you report in good faith, you will not be penalized even if the report is ultimately not upheld. Honest mistakes are expected and welcome.
Reporter identity is kept confidential from the reported user to the extent permitted by law.
Retaliation against a good-faith reporter is itself a violation of this Policy and may result in account action.
6.2 Prohibited reporting behavior
You may not submit reports that are false, malicious, retaliatory, automated, coordinated, or excessive. Specifically prohibited:
Knowingly reporting content or conduct that did not occur.
Reporting to obtain a refund, to remove a competitor, or to harass another user.
Filing reports in volume or in coordination to manufacture strikes against another user.
6.3 Consequences for abuse of reporting
ZapView weights the impact of a report by the credibility and history of the reporter. Reports from accounts with a pattern of unfounded or bad-faith reports carry reduced or no weight.
ZapView may rate-limit the number of reports an account may file.
Abuse of the reporting system is a violation of this Policy and may result in warnings, suspension, or permanent ban of the reporting account, and forfeiture of any related refund.
7. Enforcement and account actions
ZapView enforces this Policy with broad discretion and on a graduated basis. Except for severe violations, actions follow review (Section 8); they are not based on a single unverified report.
Strike ladder: a confirmed violation generally results in (1) a warning, then (2) a temporary suspension, then (3) a permanent ban on subsequent confirmed violations.
Severe violations (including CSAM, NCII, credible threats, or sexual exploitation) may result in immediate suspension pending review and/or permanent ban, plus legal reporting, without prior warning.
Strikes may expire over time at ZapView's discretion for users who maintain good standing.
ZapView may take any action it deems appropriate to protect users and the platform, including removing content, limiting features, withholding payouts associated with violations, suspending, or terminating accounts.
8. Evidence handling and retention
ZapView does not routinely record live sessions. When a session is reported, ZapView may capture a short segment or still frames of that session solely to adjudicate the report and any appeal.
Report evidence is stored securely, accessed only for review/appeal and legal compliance, and deleted after the case and any appeal window close, except where longer retention is legally required.
For CSAM and certain illegal content, ZapView will preserve evidence and report to the appropriate authorities (including the NCMEC CyberTipline in the United States) as required by law.
9. Notice to affected users
When ZapView takes action against your account, we will notify you through available channels (in-app notice, push notification, and/or email), including:
the general reason for the action,
the level of action taken (warning, suspension, ban), and
how to appeal (Section 10).
10. Appeals and dispute resolution (operational)
If you believe an action against your account was a mistake, you may appeal through the link in your notice or via the in-app support channel.
Appeals are reviewed by ZapView. ZapView targets a review within a reasonable period for suspensions and bans.
If an appeal is upheld in your favor, ZapView will reverse the action, restore your standing, remove the associated strike, and reverse any related refund or payout adjustment where appropriate.
This operational appeal process is separate from, and in addition to, the binding dispute-resolution / arbitration provisions in the ZapView Terms of Service, which govern formal legal disputes between you and ZapView, Inc.
11. Refunds related to reports
A refund for a reported session is issued when a report is upheld, or otherwise at ZapView's discretion.
Submitting a bad-faith report to obtain a refund is prohibited (Section 6) and may result in denial of the refund and account action.
12. Legal compliance
Child safety: ZapView has zero tolerance for content that endangers minors and cooperates fully with law enforcement and NCMEC.
Image-based abuse: Consistent with applicable law (including the U.S. *Take It Down Act*), ZapView provides a mechanism to request removal of non-consensual intimate imagery and acts on valid requests within the legally required timeframe.
ZapView cooperates with valid legal process and law enforcement requests.
13. Changes to this Policy
ZapView may update this Policy. Material changes will be communicated in-app and/or by email, and continued use after the effective date constitutes acceptance. The version and effective date appear at the top of this document.
