ZapView — Terms of Service

1. Acceptance of these Terms

These Terms are a legally binding agreement between you and ZapView, LLC. By checking the acceptance box and signing in, or by creating an account or otherwise using ZapView, you acknowledge that you have read and understood, and agree to be bound by, these Terms, the Privacy Policy, and the Acceptable Use & Community Safety Policy (together, the "Agreements"). If you do not agree, do not use ZapView.

2. Eligibility

You must be at least 18 years old and able to form a binding contract. ZapView is not directed to anyone under 18, and we will remove accounts we learn belong to minors.

3. The service

ZapView is a two-sided marketplace that connects a Requester (who asks for a short live video view of a real-world location) with a nearby Provider (who streams that view). ZapView is a neutral technology platform and venue; it does not create, control, or endorse user content, and is not a party to the interaction between Requesters and Providers. ZapView does not pre-screen user content and is not responsible or liable for user content or for the acts, omissions, or conduct of any user, whether online or offline. Requesters and Providers are solely responsible for their own content, conduct, and compliance with the Agreements and applicable law.

5. Provider status — independent contractors

Providers are independent contractors, not employees, agents, joint venturers, or franchisees of ZapView, and nothing in the Agreements creates an employment, agency, or partnership relationship. Providers decide entirely for themselves whether, when, and where to be available; may accept or decline any request for any reason; are not subject to schedules, quotas, minimum hours, or exclusivity; may use competing services; and supply their own equipment. Compensation (when payments are enabled) is per completed task, not wages. ZapView does not supervise, direct, or control the manner or means by which a Provider carries out a stream, beyond enforcing the Acceptable Use Policy that applies equally to all users.

You agree to comply with the Acceptable Use & Community Safety Policy, which prohibits, among other things, content endangering minors, non-consensual intimate imagery, harassment, stalking/surveillance, filming in prohibited or private places, and illegal activity. Violations may result in warnings, suspension, or permanent ban.

9. Privacy and biometric processing consent

Your use is subject to the Privacy Policy, which explains what we collect (account, location, payment, device, and live audio/video data), how we use and share it (including processors such as Firebase, Stripe, LiveKit, and Google), and your rights.

Biometric consent. To protect bystander privacy, ZapView's software detects the geometry of faces that appear in your camera view (approximate position of eyes and nose) on your device, in real time, for the sole purpose of obscuring those faces before the video leaves your device. This face geometry is never used to identify anyone, is never stored or transmitted, and is destroyed within milliseconds of each frame being processed. Our retention and destruction policy for this data appears in the Privacy Policy. By accepting these Terms you consent in writing to this on-device biometric processing as required by certain laws (e.g., the Illinois Biometric Information Privacy Act).

10. Reporting and moderation

ZapView provides in-app reporting and enforces the Acceptable Use Policy with broad discretion, including content removal, strikes, suspension, ban, withholding of payouts associated with violations, and reporting illegal content to authorities (e.g., CSAM to NCMEC). Operational appeals are available as described in the Acceptable Use Policy.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTY THAT CONTENT IS ACCURATE, LAWFUL, OR RELIABLE. ZapView does not guarantee that a Provider will accept a request, that a stream will be available, or that content meets your expectations.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ZapView AND ITS AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS OR DATA. ZapView's TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (a) THE AMOUNTS YOU PAID TO ZapView IN THE 3 MONTHS BEFORE THE CLAIM, OR (b) US$50.

14. Indemnification

You will indemnify and hold harmless ZapView and its affiliates from claims arising out of your content, your use of the service, or your violation of the Agreements or any law or third-party right.

15. Binding arbitration and class-action waiver

PLEASE READ — THIS AFFECTS YOUR LEGAL RIGHTS.

16. Governing law

These Terms are governed by the laws of the State of California, excluding its conflict-of-laws rules, subject to the arbitration provision above. *(To be confirmed by counsel.)*

17. Changes

We may update these Terms. Material changes will be communicated in-app and/or by email; continued use after the effective date constitutes acceptance. The version and effective date appear at the top.
